License Agreement for all GdPicture.NET editions

GdPicture.NET source code is protected by European & International copyright laws. 

 

This agreement is a license agreement between you and ORPALIS (www.gdpicture.com) the "Author" for the use of an edition of the computer software you have purchased ("GdPicture.NET"). 

By using GdPicture.NET, you agree to be bound by all the terms and conditions of this license agreement. 

 

GdPicture.NET is sold in 6 different editions: 

 

- GdPicture.NET Document Imaging SDK Ultimate* 

- GdPicture.NET Document Imaging SDK 

- GdPicture.NET Image SDK 

- GdPicture.NET TWAIN PRO SDK 

- GdPicture.NET TWAIN SDK 

- GdPicture.NET Document Viewer SDK 

 

* Includes GdPicture Tesseract OCR Plugin + 1D Barcode Recognition Plugin !! 

 

Some editions don't include all features provided by GdPicture.NET: 

 

- GdPicture.NET Image SDK doesn't include PDF viewing & TWAIN acquisition features. 

- GdPicture.NET TWAIN PRO SDK doesn't include PDF viewing and image viewing features. 

- GdPicture.NET TWAIN SDK doesn't include PDF creation, PDF viewing and image viewing features. 

- GdPicture.NET Document Viewer SDK doesn't include PDF creation, image processing and PDF output features. 

 

Six different licenses are available for each of the GdPicture.NET editions: 

• One Developer License: This license entitles a single developer at a single physical address to write software with access to GdPicture.NET.
• 2 Developer License: This license entitles 2 developers of the same organization at a single physical address to write software with access to GdPicture.NET.
• 4 Developer Team License: This license entitles 4 developers of the same organization at a single physical address to write software with access to GdPicture.NET.
• 8 Developer Team License: This license entitles 8 developers of the same organization at a single physical address to write software with access to GdPicture.NET.
• Site License: This license entitles an unlimited number of developers of the same organization at a single physical address to write software with access to GdPicture.NET.
• Worldwide Site License: This license entitles an unlimited number of developers of the same organization at an unlimited number of physical addresses to write software with access to GdPicture.NET.

 

 

GdPicture.NET can be distributed with your application on a royalty-free basis. This means that you can distribute as many applications using GdPicture.NET as you wish, without restrictions or royalties. 

 

GdPicture.NET may be used on any server, as long as access to the functionality of our components is via your own software. In other words, the public should not have direct access to GdPicture.NET. 

 

GdPicture.NET may be installed on any third party hosting server as long as each developer using GdPicture.NET has their own license key. 

 

GdPicture.NET may not be installed on a hosting provider's server with a single license key used by all the hosting provider's customers. 

 

We request that you do not disclose your license key to third parties. 

 

You are not allowed to sell GdPicture.NET or your license key to other people. 

 

You are prohibited from disclosing your license key to other people. 

 

You are not allowed to disclose your license key on a public web page (any page that can be read outside of your organization). 

 

This license is not a sale. Title and copyrights to GdPicture.NET, accompanying Documentation and any copy made by you remain with the Author. Unauthorized copying of GdPicture.NET or the accompanying Documentation or failure to comply with the above restrictions, will result in automatic termination of this license. 

 

GdPicture.NET may be embedded in any application or system developed by you or your organization and distributed without restriction. 

 

GdPicture.NET may not be used to develop software toolkits, API, libraries, components or third party command line software, except as authorized in writing by a duly authorized officer of ORPALIS. 

 

GdPicture.NET may also be distributed alongside your application. No royalties are payable for the re-distribution of GdPicture.NET. 

 

GdPicture.NET may be used on any server on the condition that public access to the Software is via your own application or software. 

 

GdPicture.NET may be installed on a shared hosting server, provided that each customer accesses GdPicture.NET with their own license key. 

 

You may not alter, decompile, disassemble, or reverse engineer GdPicture.NET. 

 

You may not remove, or alter the copyright notices. 

 

You may not rent, lease, sub-license or transfer GdPicture.NET, GdPicture.NET copies, Documentation, License Keys or your rights under this license without the prior written consent of the Author. 

 

The Author's entire liability and your exclusive remedy under this warranty will be, at the Author's discretion, to attempt to correct or help you resolve errors with efforts that the author believes appropriate to the problem, to replace GdPicture.NET with functionally-equivalent software, or to refund the purchase price and terminate this Agreement. 

 

EXCEPT FOR THE PRIOR EXPRESS LIMITED WARRANTIES, THE AUTHOR MAKES, AND YOU RECEIVE, NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR IN ANY COMMUNICATION WITH YOU, AND THE AUTHOR SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE AUTHOR DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. 

IN NO EVENT WILL THE AUTHOR BE LIABLE FOR ANY DAMAGES, INCLUDING LOSS OF DATA, LOST PROFITS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING FROM THE USE OF THE SOFTWARE OR ACCOMPANYING DOCUMENTATION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOU ACKNOWLEDGE THAT THE LICENSE FEE REFLECTS THIS ALLOCATION OF RISK. 

 

 

This agreement is the entire agreement between you and the Author, and supersedes any other communication or advertising with respect to GdPicture.NET and related products. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
